On June 30, 2026, Colorado’s Artificial Intelligence Act (SB 24-205) takes effect. It is the first comprehensive US state law requiring developers and deployers of high-risk AI systems to maintain audit-ready documentation, conduct annual impact assessments, and implement risk management programs to prevent algorithmic discrimination. If you are building or deploying AI agents, you have 103 days to get your stack in order.
This is not a future problem. This is a current engineering decision.
What the Law Actually Requires
The Colorado AI Act creates two categories of obligation: one for developers (those who build AI systems) and one for deployers (those who use AI systems to make consequential decisions).
Developers must:
- Exercise reasonable care to protect consumers from algorithmic discrimination
- Publish technical documentation sufficient for deployers to complete impact assessments
- Make public statements describing the types of high-risk systems they develop
- Notify deployers and the Colorado Attorney General of any discovered algorithmic discrimination within 90 days
- Implement ongoing monitoring and auditing processes
Deployers must:
- Adopt a risk management policy and program that is “iterative” and “regularly and systematically reviewed”
- Complete impact assessments before deployment, annually thereafter, and within 90 days of any substantial modification
- Retain impact assessments for at least three years
- Provide pre-decision and adverse-decision notices to affected consumers
- Publish website disclosures about their use of high-risk AI systems
A “high-risk” system is one that makes, or is a substantial factor in making, consequential decisions in education, employment, financial services, government services, healthcare, housing, insurance, or legal services. If your AI agents touch any of these domains, you are in scope.
Why Agent-Based Systems Have a Harder Problem
Traditional AI systems — a credit scoring model, a resume screener — are relatively bounded. You can point to the model, its training data, and its decision boundary. Documentation is straightforward, even if tedious.
Agent-based systems are different. An AI agent may:
- Chain multiple model calls together, each influencing the next
- Invoke external tools and skills dynamically based on context
- Make decisions across sessions with persistent memory
- Delegate subtasks to other agents, creating nested decision chains
- Modify its own behavior based on feedback loops
Each of these properties makes the audit trail harder to construct after the fact. When the Attorney General asks “how did your system arrive at this decision?”, you need a complete record of every model invocation, tool call, skill execution, and inter-agent delegation that contributed to the outcome. A 2026 NeuralTrust survey found that 73% of CISOs are critically concerned about AI agent risks, but only 30% have mature safeguards in place. The gap between awareness and readiness is the compliance risk.
The law does not distinguish between a single-model system and a multi-agent orchestration. Both must produce the same documentation, the same impact assessments, and the same audit trail. But the engineering required to capture that trail in an agent system is fundamentally more complex.
What an Audit-Ready Agent Stack Looks Like
Based on the law’s requirements and the NIST AI Risk Management Framework (which provides an affirmative defense under SB 205), an audit-ready agent stack needs five capabilities:
1. Decision Provenance. Every consequential decision must be traceable to its inputs: which model was called, what prompt was used, what tools were invoked, what data was accessed. This is not logging. This is a structured, queryable record that can reconstruct the full decision path months or years later.
2. Identity Attestation. Every agent in the system must have a verifiable identity. You need to know which agent made which decision, what permissions it had, and whether it was authorized to act in that context. The Saviynt CISO AI Risk Report found that 92% of organizations lack full visibility into AI identities and 86% do not enforce access policies for AI identities. This is a compliance failure waiting to happen.
3. Immutable Audit Trail. Impact assessments, risk analyses, and decision records must be retained for three years. Storing them in a database you control is necessary but not sufficient. An auditor needs confidence that records have not been modified after the fact. Immutability is not a nice-to-have; it is the foundation of credible compliance.
4. Continuous Monitoring. The law requires “ongoing monitoring and auditing.” This means your compliance posture is not a point-in-time snapshot. You need real-time detection of behavioral drift, discrimination patterns, and unauthorized actions. Annual assessments are the minimum; the monitoring that feeds into them must be continuous.
5. Discrimination Testing. Impact assessments must include an analysis of whether the system poses “known or reasonably foreseeable risks of algorithmic discrimination.” For agent systems, this means testing not just individual model outputs but the emergent behavior of the entire agent pipeline, including tool selection patterns and delegation decisions.
How On-Chain Attestation Solves the Trust Problem
The hardest part of compliance is not generating documentation. It is proving that the documentation is authentic and complete.
Consider the auditor’s dilemma: you present an impact assessment dated January 15. The auditor has no way to verify that you actually conducted that assessment on January 15, rather than generating it retroactively when the audit was announced. Timestamps in your own database prove nothing to a third party.

- Verifiable History: Any auditor, regulator, or consumer can independently verify the complete compliance history of an agent without relying on the operator’s self-reported records
This is not about putting AI on a blockchain for its own sake. It is about creating the kind of independently verifiable audit trail that regulators will increasingly demand. When the Colorado Attorney General’s office investigates a complaint, the difference between “we have internal logs” and “here is a cryptographically verifiable record on a public ledger” is the difference between a contested claim and a provable fact.
Seven Steps to Take in the Next 103 Days
1. Scope your exposure. Inventory every AI system in your organization. Identify which ones make or influence consequential decisions in the eight covered domains. If you are unsure, assume you are in scope — the definition is broad.
2. Map your decision chains. For each agent system, document the complete decision path: model calls, tool invocations, skill executions, inter-agent delegations. If you cannot reconstruct why a decision was made, you cannot complete an impact assessment.
3. Implement structured logging now. Do not wait until June to start capturing decision provenance. You need historical data to complete your first impact assessment. Every week you delay is a week of compliance-relevant activity with no audit trail.
4. Establish agent identities. Every agent that participates in a consequential decision needs a documented, verifiable identity. This includes the agent’s capabilities, permissions, and authorization scope.
5. Draft your risk management policy. The law requires an “iterative” program that is “regularly and systematically reviewed.” Start with the NIST AI RMF (AI 100-1) as your framework — compliance with recognized standards provides an affirmative defense.
6. Conduct a discrimination baseline. Test your agent systems for algorithmic discrimination now, before the law takes effect. Document the methodology, results, and any mitigations. This becomes the foundation of your first impact assessment.
7. Evaluate immutable audit infrastructure. Determine whether your current logging and documentation systems meet the three-year retention and auditability requirements. If an external auditor cannot independently verify your records, consider on-chain attestation as a trust layer.
The Bigger Picture
Colorado is first, but it will not be last. The EU AI Act is already in phased implementation. Multiple US states have AI legislation in committee. Federal frameworks are under active development. The organizations that build audit-ready agent infrastructure now will have a structural advantage as regulation scales.
The 103-day countdown is not just about one state law. It is about whether your agent stack was designed for a regulated world or will need to be retrofitted for one.
